JS World Media values the protection of personal data, and therefore we place great emphasis on protecting your privacy. This Privacy Policy explains and clarifies how we, as a data controller, process our visitors’, customers’ and job applicants’ personal data according to the General Data Protection Regulation (“GDPR”). This policy will apply in situations where JS Deutschland GmbH, JS Schweiz GmbH and JS Österreich GmbH & Co. KG (hereinafter referred to as « JS », « we », « us » and « our ») treat personal data that we collect from you or that you provide to us online or that we obtain from other sources as stated below. Please note that we assume that if you provide information to us or make use of our services, you have read this Privacy Policy and agree to it.

What is personal data?

Personal data is any information relating to an identified or identifiable natural person; an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

1. If you are a JS business partner, including supplier, customer or a supplier/business partner of our customer

This section sets out the policy of JS’s processing of personal data collected from contact persons at JS’s customers, suppliers and other business partners who collaborate with JS (directly and indirectly).

Processing of personal data about our business relations

JS may collect, process and store personal data about you in the following instances:

  • When your company or the company you are employed with enters into an agreement with JS, including buys services offered by JS (e.g. a professional communication package)
  • When you make use of JS’s website and portals
  • When you collaborate and communicate with JS

Types of personal data

JS may collect, process and store the following personal data:

  • Name, e-mail address, telephone number and similar identification data
  • Organizational data, such as company name, company address, job position, business area, primary work location and country
  • Contractual data, such as purchase orders, invoices, contracts and other agreements between your company (or your employer) and JS, that may include e.g. your contact information and signature.
  • Financial data, such as payment terms, bank account details and credit ratings
  • IT-related data, such as logs about your usage (including profile details) of JS’s website and portals (e.g. Cockpit)
  • Other details about our professional relationship, including our communication

Purpose of the processing

Your personal data may be processed for the following purposes:

  • To provide high-quality communication packages
  • Generally, to plan, perform and manage the business relationship, including any current or future contractual relationships
  • Administration, such as processing payments (including collection of outstanding invoices), performing accounting, auditing, billing activities as well as providing support services
  • Marketing activities (via electronic and non-electronic means)
  • Completion of requests received from you
  • To improve and optimize our online platforms
  • Evaluation and development of our services, including statistics and analytics
  • Dispute handling
  • Compliance with legal obligations to which we are subject (e.g. commercial laws, tax laws, fraud prevention laws, etc.)

Legal basis

JS will mainly process your personal data based on the following legal bases:

  • Contractual obligation: The processing of your personal data will in some cases be necessary for the performance of a contract to which you are party (Article 6(1)(b) of the GDPR).
  • Legitimate interests: We may process your personal data pursuant to our legitimate interest in, for instance, to manage daily operations according to lawful and fair business practices, including planning, performing and managing the business relationship or our legitimate interest in e.g. fulfilling our contractual rights and obligations with our company, statistics, analysis, marketing activities (where consent is not required), providing support as well as improving and developing our products and services (Article 6(1)(f) of the GDPR).
  • Legal claims: The processing may also be necessary to prevent fraud or establish, exercise or defend legal claims (Article 6(1)(f) of the GDPR).
  • Consent: We may process your personal data on the basis of your consent, e.g. to receive some categories of marketing material (Article 6(1)(a) of the GDPR).
  • Legal obligation: The processing of your personal data will in some cases be necessary to comply with legal obligations, such as our obligations to prevent illegal activity (Article 6(1)(c) of the GDPR).

Retention period

  • Your personal data will be deleted when it is no longer needed for one or more of the purposes mentioned above. In general, this means that we keep collected personal data until our current and future relationship is terminated definitely.

However, subject to other requirements under local law, the following retention periods apply:

  • Personal data included in accounting records is kept for 6 to 10 years from the end of the financial year to which the records relates.
  • In individual cases, the data may also be kept longer due to certain legal requirements of the respective country.
  • Personal data collected in connection with business, support or other commercial activities will be stored as long as such data is relevant for the handling and monitoring of the issue in question.
  • Personal data may be stored for a longer period if we are required to store your personal data for a longer period due to legal requirements or if necessary, for the purpose of defending a specific claim or dispute.

Processing of personal data about visitors on our website

JS may collect, process and store personal data about you in the following instances:

  • When you visit and browse our websites
  • When you communicate with JS
  • When you make use of other functions and services offered by JS

  • Name, e-mail address, telephone number and similar identification data
  • Company name and company address
  • Branch/business area
  • Content of inquiries
  • IP address and browser settings
  • Information about your usage of our websites

Cookies

Cookies are small files that our online platforms or service providers send to the hard disk of your computer through the browser (if you allow) and which cause the site to recognize your browser and retrieve and remember certain information.

We use cookies to execute some essential functionalities and improve the user experience as well as compile statistics on traffic and communication on the online platforms.

Cookies are also used for communication purposes to improve our customer communication and online platform analytics. Cookies tell us which sites our online platform users have visited; help us measure and target our advertising and marketing activities as well as identify search results through internet search engines; and provide us with information about our users so that we can improve our online services.

JS will mainly process your personal data based on one or more of the following legal bases:

  • Legitimate interests: In most cases, the processing of your personal data will be based on our legitimate interest in, for instance, conducting statistics, analysis, marketing activities (where consent is not required), providing support as well as improving and developing our products and services (Article 6(1)(f) of the GDPR).
  • Consent: In some cases, we need your consent, e.g. in order for us to place cookies on your devices (Article 6(1)(a) of the GDPR).

Retention period

Your personal data will be deleted when it is no longer needed for one or more of the purposes mentioned above. Please refer to our cookie policy for information about the expiry of cookies placed on your device.

The personal data may, however, be processed and stored for a longer period of time if anonymised.

3. If you visit our social media pages

JS and the social media providers are jointly responsible for the processing of your personal data collected in connection with your visit to JS’s profile or page on the individual social media platform. JS complies with the guidelines of the European supervisory authorities concerning joint controllership and JS attempts to ensure that you receive information on the processing of your personal data when you visit our social media pages.

Collection of personal data

When you visit or interact with our social media profiles, JS and the social media provider may collect, process, and store the following types of personal data about you:

  • Information available on your profile, including your name, gender, civil status, workplace, interests, image, and your city
  • Whether you “like” or have applied other reactions to our profile
  • Comments you leave on our posts
  • That you have visited our profile

The purposes of the processing

JS processes your personal data for the following purposes:

  • Improving our products and services, including our social media profiles and pages
  • Statistics and analysis
  • To be able to communicate with you if you comment on a post, make a review, or send us a message
  • Marketing in general

Social media providers process your personal data for the following purposes:

  • Improving their ad system
  • To provide JS with statistics which the social media providers produce based on your visit to our profiles and pages
  • Advertising and customizing the activities on the page

Legal basis

The processing of your personal data is based on the following basis:

  • Legitimate interests: JS bases the processing of your personal data on our legitimate interests in being able to communicate with and market us to you on our social media profiles, as well as our legitimate interest in improving our products and services (Article 6(1)(f) of the GDPR).
  • Social media providers base the processing of your personal data on their legitimate interests, including their interest in improving their ad system and providing statistics to JS, which the social media provider, for example, prepares based on your visit to JS’s profile or social media page. In addition, the social media providers have a legitimate interest in providing an innovative, individually adapted, secure and profitable service (Article 6(1)(f) of the GDPR).    
  • Consent: The social media providers process some of your personal data in accordance with your consent, which you can withdraw at any time through your social media privacy settings (Article 6(1)(a) of the General Data Protection Regulation).

Retention period

We delete private messages no later than after 2 years. However, the information can be stored for a longer period in an anonymized form.

We encourage you to delete comments, likes and other interactions you have left on our profile yourself if you no longer want them shown on our pages. JS does not delete such publicly available interactions.

Please refer to the privacy policy of the provider for each of the social media platforms for information on how long they store your personal data.

Who do social media providers share your personal data with?

Social media providers may, among other things, share your personal data with the following categories of recipients:

  • Other devices in the group of which the social media provider is a part of
  • External partners providing analysis- and survey services
  • AdvertisersOther individuals visiting our social media profile or page (to the extent that your information is publicly available)
  • Researchers

The social media providers may transfer their personal data to recipients outside the EU/EEA in accordance with applicable data protection legislation. You can read more in each provider’s privacy policy.

4. If you are applying for a job at JS

Processing of personal data about job applicants

In order to evaluate your application, we will process the personal data, which you have disclosed in your job application and CV as well as any attachments and store it in our Candidate Pool. We will also evaluate your performance and competencies during potential interviews as well as support statistical purposes on an anonymous basis. The legal basis for our processing of your personal data is your application for execution of an employment contract with JS, cf. Article 6(1)(b) of the GDPR and our legitimate interest in processing the information you have given us, cf. Article 6(1)(f) of the GDPR.

If permitted by the legal basis of the respective country, we may search the internet for relevant and available information, including content from social media. As a rule, we search for information about your previous jobs, activities, skills, achievements as well as your general appearance.

If the job position requires you to complete personality tests or similar you will be informed hereof when we have processed your application. The results of such tests will be treated confidentially but will be included in our evaluation of your application. Our legal basis for such processing of personal data is Article 6(1)(b) of the GDPR.

As part of our evaluation of you and your application, we may wish to take references from your previous and/or current employers. We will always obtain your explicit consent before collecting information from references. Our legal basis for such processing is Article 6(1)(f) of the GDPR as we have a legitimate interest in assessing whether we wish to offer you a position, including on the basis of your performance with previous employers.

We recommend that you do not disclose sensitive personal data, such as information revealing racial or ethnic origin, religion or philosophical beliefs, trade union membership, sexual orientation, health, etc. in your application. In the unlikely event that a certain health condition is required for the ability to perform the duties related to the position in question, we might – after a concrete assessment – request health information from you. In such case we will ask for your consent, whereas our legal basis for such processing of personal data is Article 6(1)(a) and Article 9(2)(a) of the GDPR.

In all of the scenarios where the processing of your personal data is based on your consent, your relationship with JS will not depend in any manner on the fact that you grant your consent for such processing.

Retention period

If you are offered a position with JS, your application and additional relevant personal data obtained during the recruitment procedure will be stored in your employee file according to Article 6(1)(b) of the GDPR.

If you are not offered a position, we will store your application and any additional personal data obtained during the recruitment procedure for a period of 6 months following our rejection.

Any consent that you may have provided during the recruitment procedure may be withdrawn at any time. The withdrawal of your consent will affect the future processing of your personal data but will not affect the lawfulness of processing based on consent before its withdrawal. If you wish to withdraw a consent, you may contact us as stated below.

5. General information applicable for all individuals covered by this privacy policy

With whom do we share your personal data?

We may share your personal data with trusted third parties (data processors) that help us run online platforms, conduct our business, deliver the communication package you order or provide services, as long as these parties agree to keep the information confidential and only to use it in accordance with our instructions. We have entered into agreements with such third party service providers. These service providers are not allowed to use the information they collect on our behalf for anything other than helping us operate and improve our business.

We may disclose your personal data to companies within our group (i.e. our ultimate holding company and all its subsidiaries) insofar as it is reasonably necessary for the purposes stated in this Privacy Policy.

We may also disclose your personal data to e.g. tax and fraud prevention authorities if we find it necessary in order to comply with statutory requirements and our legal obligations (commercial laws, tax laws, fraud prevention laws, etc.), relying on the legal basis under Article 6(1)(c) of the GDPR.

Furthermore, under this legal basis your personal data may be disclosed to accountants. Under certain circumstances it may also be necessary to disclose your personal data to lawyers, courts, public authorities and the police to establish, exercise or defend legal claims in accordance with Article 6(1)(f) of the GDPR.

We do not sell or trade your personal data to third parties. However, in connection with JS’s development, the company structure may change, e.g. through a full or partial sale of JS. In case of a partial hand over of assets containing personal data, the legal basis for the related disclosure of personal data is, as a general rule, JS’s legitimate interest in handing over parts of its assets as well as making commercial changes (Article 6(1)(f) of the GDPR).

If your personal data is transferred to data processors or data controllers established in countries outside the EU/EEA which do not have an adequate level of protection, such transfers will in general be based on the EU Commission’s Standard Contractual Clauses EU 2021/914 which you have a right of access to. You can ask for a copy of such appropriate safeguards by contacting us as set out below.

We have implemented numerous security measures to prevent, for example, the loss and misuse of personal data under our control. Accordingly, we use our best endeavors to protect the quality and integrity of your personal data.

Your rights

You have a right of access to the personal data, which we process and store about you, subject to certain statutory exceptions. Furthermore, you have the right to object to the processing and request restriction of the processing of your personal data. In addition, you also have the right to request rectification, including completion or deletion of your personal data, if necessary.

Under certain circumstances, you may also request that we provide you with a copy of your personal data in a structured, commonly used and machine-readable format and request us to transmit such personal data which you have provided us with to another data controller (the right to data portability).

You may at any time exercise the aforesaid rights as well as withdraw any consents you may have provided us with during your employment. The withdrawal of consent will affect the future processing of your personal data.

As a part of our products or services, we may use third-party links on our online platforms. The companies behind such links are data controllers and have their own independent privacy rules. Therefore, we take no responsibility for the content and activities of these linked sites. However, as we want to protect the privacy on our online platforms, we welcome comments on these links.
